Apple & Eve Big Apple Circus Holiday Weekend in NYC Instant Win Game Official Rules No Purchase Necessary to Enter or Win Open to legal U.S. residents residing in ME, MA, NY, PA, RI, VT, NH, CT, NJ, DE, VA, MD, WV, FL, GA or DC, 18 years of age & older as of November 12, 2006.

1. How to Play Instant Win Game: Beginning 9:00 AM EST on November 12, 2006 through 11:59 PM EST on November 30, 2006, visit www.appleandeve.com, click on the Big Apple Circus Game link and complete the registration page by entering your name, complete address, email address and birth date. Each subsequent day you enter/play, you need only input your email address. Once you submit your information, an online game will appear. To play, click on the "play" button to see if you reveal a winning message or a discount. If your game play reveals a winning message, you win the prize indicated, subject to verification. If your game play reveals that you are not a winner, you will automatically be entered into the Second Chance random drawing. If you have won an instant win prize, print a copy of the prize message for your records.  You will be notified on-screen as to when you will receive either an affidavit package or your prize, depending on level (see Rule #3).  Normal Internet access, phone and usage charges imposed by your on-line or phone service may apply.  Limit one online game play per person/email address per day.

2. Instant Win Prizes and Odds of Winning: Grand Prize (1): A 3 day/2 night trip for a family of up to four (4) people (including and limited to: parents, grandparents, and children/grandchildren) to see the Big Apple Circus in New York City.  Trip includes round trip coach class air transportation from the major airport closest to the winner's home to Sponsor's choice of any of the three New York City airports, hotel accommodations at the Doubletree Suites New York, based on quad occupancy, round trip transportation to/from airport and the hotel, up to four (4) front row seats to the Big Apple Circus and $400 spending money for winner, awarded in the form of a check.  Trip must be taken on one of the following weekends: December 29th OR January 5th (ERV: up to $7,329); odds 1:380,000. First Prizes (10): A Big Apple Circus Goody Bag, consisting of a Big Apple Circus T-shirt, a souvenir book, a signed poster of Grandma, a coffee mug, stickers, a red nose and a night light (ERV: $150/each); odds 1:38,000. Second Prizes (20): An Apple & Eve Gift Basket, consisting of an Apple & Eve hat, t-shirt, beach blanket, beach bag, ruler, lanyard, bookmark, writing board and a variety of juices (ERV: $100/each); odds 1:19,000.  Approximate odds of winning any instant win prize are 1 in 12,258.  Grand Prize, if unclaimed, will be awarded in the Second Chance random drawing (see Rule #5). UNCLAIMED FIRST AND SECOND INSTANT WIN PRIZES AND DISCOUNTS WILL NOT BE AWARDED. Limit one prize per person/email address.

3. How to Claim Your Prize: If you have won the Grand Prize, you will automatically receive an affidavit package (as described in Rule #6), via mail within one week after verification. If you have won a First or Second Prize, you will automatically receive your prize within 6-8 weeks after verification. 

4. Verification: All game messages are subject to verification at sole discretion of Sponsor.  In no event will more than the listed prizes be awarded.  If more Grand, First or Second Prize messages are revealed for any prize level greater than the number of prizes listed for that level, those prizes listed will be awarded in a random drawing from among all verified online claims received for that level.  Use of automated entry devices or programs is prohibited. The Sponsor and its agencies assume no responsibility for any injury or damage to participants' or to any other person's computer relating to or resulting from entering or downloading materials or software in connection with this promotion.

5. Second Chance Random Drawing: Grand Prize, if unclaimed, will be awarded in a Second Chance random drawing, conducted on or about December 1, 2006, from among all eligible Second Chance entries received. Drawing will be conducted by Don Jagoda Associates, Inc., an independent judging organization whose decisions are final on all matters relating to this promotion.  Odds of winning the Grand Prize in the Second Chance random drawing depend upon whether the Grand Prize is unclaimed and the total number of eligible Second Chance entries received. Grand Prize will be awarded and winner will be notified by phone/overnight mail.

6. General Rules: No substitution or transfer of prize permitted except at the sole discretion of the Sponsor who reserves the right to substitute a prize of equal or greater value in the event a prize (or portion of prize) is unavailable. All federal, state and local taxes are the sole responsibility of winners, if applicable. In the event of a dispute regarding a prize won online, that game play will be deemed made by the authorized account holder at the time of game play. The Grand Prize winner will be required to execute and return an Affidavit of Eligibility/Release of Liability/Publicity Release ("affidavit package"), where legal, within 5 days of notification attempt. Noncompliance within this time period may result in disqualification and in the instance of the Grand Prize, an alternate winner will be selected, time permitting.  Affidavit package will be mailed via overnight mail with a pre-paid overnight return envelope included.  Return of any prize or prize notification as undeliverable may result in disqualification. Grand Prize winner and travel companions must travel together and must have valid travel documents (i.e., valid photo ID) prior to departure.  Grand Prize winner's travel companions (or parent/legal guardian if companion is a minor) must execute a Release of Liability prior to departure.  Airline carrier's regulations and conditions apply.  Trip must be taken on dates specified by Sponsor surrounding the Big Apple Circus and trip is subject to availability and confirmation of reservations. Dates of departure and return are subject to change. Certain restrictions apply. By participating in this promotion, participants agree to be bound by the Official Rules and the decisions of the judges. The Sponsor and its agencies are not responsible for mistranscribed or faulty telephone communication for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in this promotion or by any human error which may occur in the processing of the game plays/entries in this promotion. The Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the game play process or the operation of the game/drawing or website; violates the Official Rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. The Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the promotion if it is not capable of running as planned, including, but not limited to, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures or any other problems beyond the control of the Sponsor and award remaining instant win prizes claimed prior to cancellation and award the Grand Prize from all eligible Second Chance entries received prior to cancellation, if applicable. The Sponsor and each of its respective affiliates, officers, directors, agents, and employees will have no liability or responsibility for any claim arising in connection with participation in this promotion or any prize awarded. Winners assume all liability for any injury or damage caused, or claimed to be caused, by participation in this promotion or by use or redemption of any prize or by any related activities. Acceptance of any prize constitutes permission to use winners' names and likenesses for promotional purposes without further compensation except where prohibited by law. The Sponsor is not responsible for any typographical or other error in the printing of the game materials or the offering or announcement of the prizes. In the event any dispute arises regarding the promotion, each participant agrees that such dispute shall be resolved by applying the laws of New York and that it shall be resolved within and by the courts of that state.
